1. Agreement to Terms

The website located at https://aibe.org and all affiliated domains, subdomains, digital platforms, software, membership portals, applications, dashboards, and related services (collectively, the “Site”) are owned and operated by The American Institute Of Bankability Experts (“AIBE,” “we,” “us,” or “our”).

By accessing or using the Site, purchasing products or services, enrolling in membership or certification programs, or interacting with AIBE content in any manner, you agree to be legally bound by these Terms of Service (“Terms”), our Privacy Policy, and any additional policies incorporated herein.

If you do not agree, you must discontinue use immediately.

2. Organizational Purpose

AIBE is a private educational institution focused on the development, teaching, and advancement of the Bankability® framework, including financial education, asset structuring methodologies, capital strategy principles, certification programs, proprietary assessments, and related intellectual property.

AIBE provides proprietary educational content and internal certifications only.

2.1 No Government Accreditation or Professional Licensure

AIBE is not:

• A government-recognized accrediting body
• A university or degree-granting institution
• A law school, business school, or financial institution
• A Certified Financial Planner Board of Standards entity
• A registered investment adviser
• A broker-dealer
• A bank or lending institution
• A credit reporting agency
• A CPA firm
• A law firm
• An insurance agency
• A mortgage originator

AIBE is not registered with:

• The U.S. Securities and Exchange Commission (SEC)
• The Financial Industry Regulatory Authority (FINRA)
• Any state securities regulator
• Any state bar association
• Any state accountancy board
• Any federal or state banking authority

AIBE does not issue state-recognized, federally-recognized, or government-licensed professional credentials.

The designation “Certified Bankability Expert” and all related Bankability® certifications are proprietary educational designations issued solely by AIBE. These designations do not constitute licensure, accreditation, regulatory approval, or authorization to provide regulated financial, legal, tax, securities, insurance, lending, fiduciary, or investment advisory services.

2.2 No Fiduciary Relationship

Your use of the Site, enrollment in programs, participation in courses, or receipt of any certification does not create:

• A fiduciary relationship
• An advisory relationship
• A client relationship
• A partnership
• An agency relationship
• A joint venture

AIBE does not assume any fiduciary duties, advisory obligations, suitability obligations, or best-interest standards toward users, members, or certification holders.

All decisions made by users are made independently and at their own risk.

2.3 Securities and Financial Services Disclaimer

Nothing contained within the Site, courses, materials, communications, or certifications constitutes:

• Investment advice
• Securities recommendations
• Financial planning advice
• Legal advice
• Tax advice
• Insurance advice
• Lending advice
• Mortgage origination services
• Broker-dealer activity
• Investment advisory services

AIBE does not provide advice regarding the purchase, sale, or holding of securities.

No content should be interpreted as a solicitation, offer, or recommendation to buy or sell any financial instrument.

Users are solely responsible for ensuring compliance with all federal, state, and local licensing laws applicable to their professional activities.

You are strongly encouraged to consult licensed professionals before making financial, legal, tax, or investment decisions.

2.4 No CFP® or Third-Party Credential Affiliation

AIBE is not affiliated with, endorsed by, sponsored by, or approved by:

• The Certified Financial Planner Board of Standards (CFP Board)
• Any CPA board
• Any state bar association
• Any securities regulator
• Any financial licensing authority

The Bankability® certifications are proprietary educational designations and must not be represented as equivalent to, a substitute for, or comparable to any government-regulated professional credential.

Certification holders may not:

• Represent themselves as Certified Financial Planners (CFP®) unless separately licensed
• Represent AIBE certification as a state-recognized license
• Suggest regulatory endorsement
• Use AIBE marks in a manner implying governmental approval
• Misrepresentation of certification status may result in immediate revocation and potential legal action.

2.5 Educational Purpose Only

All materials are provided strictly for educational purposes.

AIBE makes no guarantees of financial outcomes, income levels, asset growth, capital gains, leverage success, or wealth creation.

Use of the Bankability® framework does not guarantee financial success.

3. Intellectual Property and Brand Protection

3.1 Ownership

All content on the Site — including text, graphics, video, audio, course materials, training programs, software, tools, assessments, branding, trademarks, service marks, and proprietary methodologies — are owned exclusively by AIBE or its licensors.

All rights reserved.

3.2 Bankability® Trademark and Brand Portfolio

Bankability® is a protected brand and intellectual property asset of The American Institute Of Bankability Experts.

These marks, whether registered or unregistered, constitute proprietary intellectual property of AIBE.

Unauthorized reproduction, imitation, derivative use, confusingly similar branding, domain registration, commercial exploitation, or misrepresentation of affiliation is strictly prohibited.

AIBE reserves all rights to enforce its intellectual property through civil or criminal remedies.

4. Limited License

You are granted a limited, revocable, non-transferable license for personal, non-commercial educational use only.

You may not:

• Copy, republish, distribute, sell, sublicense, or exploit materials
• Create derivative works
• Reverse engineer software or tools
• Frame or mirror content
• Use branding in a misleading or unauthorized manner

UNDER NO CIRCUMSTANCES, INCLUDING, BUT NOT LIMITED TO, NEGLIGENCE, SHALL WE, OUR SUBSIDIARY AND PARENT COMPANIES OR AFFILIATES BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES THAT RESULT FROM THE USE OF, OR THE INABILITY TO USE, THE SITE, INCLUDING OUR MESSAGING, BLOGS, COMMENTS OF OTHERS, BOOKS, EMAILS, PRODUCTS, OR SERVICES, OR THIRD-PARTY MATERIALS, PRODUCTS, OR SERVICES MADE AVAILABLE THROUGH THE SITE OR BY US IN ANY WAY, EVEN IF WE ARE ADVISED BEFOREHAND OF THE POSSIBILITY OF SUCH DAMAGES. 5. Educational Disclaimer

All content provided through AIBE — including courses, certifications, materials, tools, and communications — is for educational purposes only.

AIBE does not provide legal, tax, financial, or investment advice.

No guarantees of income, financial success, capital gains, or specific results are made or implied.

Users are encouraged to consult licensed professionals before making financial decisions.

All materials are provided “AS IS” without warranties of any kind.

6. Membership and Certification

Enrollment in any AIBE membership or certification program:

• Does not create partnership, agency, or fiduciary relationship
• Does not guarantee certification unless requirements are fully met
• May be revoked for violation of brand standards or conduct guidelines
• Is subject to eligibility criteria determined by AIBE

Certification marks may only be used in accordance with official brand guidelines.

7. Payments and Refunds

All purchases are final unless otherwise stated in writing.

Membership fees, subscription payments, certification fees, event tickets, and digital products are non-refundable unless explicitly specified.

AIBE may revoke access for chargebacks or fraudulent disputes.

Users are responsible for maintaining valid payment information.

8. Limitation of Liability

To the fullest extent permitted by law:

AIBE shall not be liable for any indirect, incidental, consequential, punitive, or special damages arising from:

• Use or inability to use the Site
• Reliance on educational content
• Third-party tools or services
• Business or financial decisions made by users

Maximum liability shall not exceed the amount paid to AIBE in the preceding twelve months.

9. Arbitration and Class Action Waiver

All disputes shall be resolved exclusively through binding arbitration on an individual basis.

No class actions or consolidated proceedings permitted.

If the class action waiver is unenforceable, arbitration shall not apply.

10. DMCA and IP Enforcement

AIBE owns and controls valuable intellectual property, including but not limited to:

• Bankability®
• Certified Bankability Expert®
• All marks listed in Section 3.2
• All proprietary frameworks, methodologies, assessments, scoring models, dashboards, systems, reports, training materials, certification standards, and software tools
• All original written, audio, video, and visual content

AIBE actively monitors and enforces its intellectual property rights.

10.1 Copyright Protection

All Site content is protected under United States copyright law and applicable international treaties.

Unauthorized reproduction, copying, distribution, scraping, AI ingestion, republication, public display, resale, or derivative use of AIBE content is strictly prohibited.

This includes but is not limited to:

• Course downloads and redistribution
• Recording or rebroadcasting training sessions
• Republishing written materials
• Uploading AIBE content to third-party platforms
• Using AIBE materials to train artificial intelligence systems
• Creating derivative educational programs using AIBE frameworks

10.2 Trademark Protection

Bankability® and all associated marks listed in Section 3.2 are proprietary brand assets of AIBE.

Unauthorized use includes:

• Registering domain names incorporating “Bankability” or confusingly similar variations
• Social media handles using Bankability branding without authorization
• Offering competing certifications using similar terminology
• Using AIBE marks in advertising without written permission
• Representing affiliation where none exists
• Using certification titles without active authorization

10.3 Certification Misuse

Individuals who misuse:

• “Certified Bankability Expert”
• “Bankability Expert”
• Any Bankability® certification title listed in these terms

Without valid certification status may face:

• Immediate revocation
• Public notice of decertification
• Legal enforcement action
• Injunctive relief
• Damages and attorney’s fees

Certification rights are conditional and revocable. 

Notices must be sent to:

Incomplete notices will not be processed.

AIBE reserves the right to remove allegedly infringing material without prior notice.

10.6 Injunctive Relief Carve-Out

Notwithstanding the Arbitration section of these Terms, AIBE may seek:

• Temporary restraining orders
• Preliminary injunctions
• Permanent injunctions
• Asset freezes
• Seizure of infringing materials
  

In any court of competent jurisdiction to protect intellectual property rights.

Users agree that monetary damages alone would be insufficient to remedy infringement.

10.7 Recovery of Costs

In any enforcement action arising from violation of this Section, AIBE shall be entitled to recover:

• Attorneys’ fees
• Court costs
• Investigation costs
• Expert witness fees
• Statutory damages
• Actual damages
• Profits attributable to infringement

To the fullest extent permitted by law.

11. Termination

AIBE may suspend or terminate access at any time without notice.

Restrictions, disclaimers, and IP protections survive termination.

12. Force Majeure

Neither party shall be liable for delays due to causes beyond reasonable control.

13. Assignment

AIBE may assign its rights freely.
Users may not assign their rights without written consent.

14. Severability

If any provision is unenforceable, the remainder remains in effect.
